Since 1986, the "Safe Drinking Water and Toxic Enforcement Act," commonly known as "Proposition 65," has been in effect in the State of California. Its purpose is to protect the population from exposure to certain chemicals that are carcinogenic or toxic to reproduction.              

Proposition 65 involves all foreign companies - including non-US companies - that directly market their products in California, as well as companies whose products reach the California market through third parties. In fact, the law also targets foreign producers, holding them directly responsible in case of violations, even if the sale in California was made through intermediaries. Furthermore, the regulation is also of interest to companies whose market is not represented by the final consumer, but by other companies and professionals, if it is foreseen that the final product may reach the Californian territory.

The penalties provided for in case of violation vary according to the seriousness of the violation and reach $2,500 per day. It should be remembered that not only public authorities can take legal action against a company, but also any private citizen can act in this sense in the public interest.
