Definition and reference legislation

Unhealthy production activities are those industrial or manufacturing activities that produce vapors, gases or other emissions that can be extremely harmful to human health and dangerous to the environment. The reference regulations are Royal Decree no. 773 of 18 June 1931, Royal Decree no. 1265 of 27 July 1934 and the Decree of the Ministry of Health of 5 September 1994.

Classification of unhealthy industries

First and Second class

Unhealthy activities, identified by Ministerial Decree of 5 September 1994, are divided into two classes:

  • First Class: activities that must be isolated in the countryside and far from dwellings.
  • Second Class: activities that require special precautions for the safety of the neighborhood.

Anyone intending to establish an industry included in the list of the aforementioned Ministerial Decree must send a specific communication to the competent authority at least 15 days before starting the activity.
