EU Chemical Trade Requirements

Regulation (EU) 649/2012 (PIC) constitutes the implementation in the EU legal system of the Rotterdam Convention. This international Convention (adopted on 10 September 1998) - to which more than 150 nations worldwide have adhered (including European Union countries) - aims to regulate the import/export of highly hazardous pesticide formulations and industrial chemicals that are banned or subject to strict restrictions. A key element of this regulation is the so-called "PIC Procedure" (Prior Informed Consent), which requires that the supply of products covered by the Convention can only take place with the prior informed consent of the importing country. Regulation (EU) 649/2012 (PIC) applies at the EU level in an even more rigorous and restrictive manner than required by the Convention: in fact, there are more substances involved and more extensive related obligations.

Any European economic operator who wishes to export certain chemical substances regulated by Regulation (EU) 649/2012 (PIC) must, in fact, verify the obligations applicable to them and carry out specific procedures (e.g., export notification, PIC procedure, etc.) in order to obtain "clearance" for the export from the Competent Authorities of the countries involved.

The PIC Regulation also provides - moreover - that all chemical products intended for export are governed by the packaging and labeling provisions of Regulation (EC) 1272/2008 (CLP) and are accompanied by a Safety Data Sheet in accordance with the provisions of Regulation (EC) 1907/2006 (REACH).
