Water discharges: regulations and definitions

Obligations set out in the Consolidated Environmental Law

Wastewater discharges, regulated in Italy by Legislative Decree 152/2006 and subsequent amendments (the Consolidated Environmental Law), are defined as any discharge made through a system that continuously connects the wastewater production cycle to the receiving body (surface water, soil, subsoil, and sewerage).
Wastewater discharges can vary depending on the nature of the wastewater: urban, assimilable to urban, industrial (originating from a production process), first flush, etc. Additionally, it is necessary to consider the provisions of local regulations (e.g., regional, provincial).

Normachem assists companies in identifying their obligations, verifying compliance, and adapting to regulations.

Verification of regulatory compliance, obligations, and fulfillments

According to Article 124 of the Consolidated Environmental Law, "all discharges must be authorized in advance”. This is aimed at preventing and reducing pollution, protecting soil, and surface, marine, and groundwater. This applies regardless of the polluting nature of the effluent, even if it has been pre-treated.

Therefore, any entity that has wastewater discharges, of any type, must comply with the obligations set forth in current legislation (national and local) to avoid administrative or criminal penalties. Normachem can help you identify the regulatory provisions applicable to your business and comply with them.
